This Agreement applies to all users of the Site, including without limitation users who are florists, vendors, customers, merchants, contributors of content, information and other materials or services on the Site or in connection with LoveWishesFlorist.com. Different sections of the Agreement may affect users different depending upon their use of the Site, so please make sure to review this Agreement carefully.

LoveWishesFlorist.com provides a venue where flower sellers (“Florists”) and other gift vendors can create listings to sell certain floral gifts and limited related goods within a fixed-price format at the Site (subject to compliance with the Florist’s Terms and Conditions set forth below) and customers who visit or utilize the Site can learn about Florists and Vendors’ listings and make purchases from Florists and Vendors (“Customers”).
LoveWishesFlorist.com also provides a venue where Florists can send orders to other Florists (“Florist-to-Florist Orders”). LoveWishesFlorist.com is not directly involved in or otherwise a party to any transactions that may take place between Florists and Customers. LoveWishesFlorist.com has no control over the quality, safety, morality or legality of any aspect of the Florist and Vendor’s listings or any claims made by Florists and Vendors about the products or services they offer, the truth or accuracy of the listings created by Florists & Vendors, the ability of Florists and Vendors to sell the items, the ability of Customer to pay for the items, the ability of the Florist and Vendor to fulfill an order in a Florist-to-Florist Order or the ability of Florists to pay for items in Florist-to-Florist Orders.
LoveWishesFlorist.com does not conduct background checks regarding any users of the Site and our verification process for Florists and Vendors is limited. LoveWishesFlorist.com is not a broker, agent or insurer for any users of the Site, whether they be Florists or Customers. LoveWishesFlorist.com makes no representations, warranties or guarantees regarding any content or information provided by the Florists & Vendors, including, without limitation, the identity, age, and nationality of any seller, buyer or user. We encourage you to communicate directly with potential transaction partners through the tools available through LoveWishesFlorist.com.
All purchases made by Customers from Florists and Vendors are made at each Customer’s own risk, and all Florist-to-Florist Orders are made at each Florist’s own risk
You acknowledge and agree that the Site is solely a venue and has no responsibility or liability for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on the Site. Your use the Site is solely at your own risk.
ORDERS, PRODUCTS, PRICE AND CANCELLATIONS
Order Acceptance Policy
All orders and other requests received are subject to acceptance by LoveWishesFlorist.com, and any of its personnel, reserve the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will refund or cancel any payments received in full, via the payment method used to place the order.
Changes to your order
If you wish to change your order, please do so via the "My Account" area of the LoveWishesFlorist.com or by contacting Customer Service at hello@lovewishesflorist.com. We'll always do our best to make last-minute changes for you, but we can only guarantee changes (including to the delivery address and in relation to card messages) that are requested by 9am the day before the intended delivery date. At peak periods we begin processing orders earlier than usual, to account for the large volume of deliveries. This means that we may need up to 3 days notice for any changes to be made.
Cancellation policy
For most items you have the legal right to cancel your order within 3 days of receiving the goods. However this does not apply to certain items which we have made, personalised or customised specifically to you. It also does not apply to perishable goods.
Cancellations for flowers and plants can only be accepted if received 3 days before the requested delivery date. Orders placed or cancelled on Saturdays, Sundays or Public Holidays will be treated as having been received by us on the following working day. For practical reasons, flowers are non-returnable.
Due to their nature, these offers are subject to availability. In the event of supply difficulties, we will substitute flowers or packaging of equal quality and value.
For personalised gifts, due to the personalised nature of the product, cancellations can only be made prior to production. If it is possible to cancel your order we will make every effort to do so. Once the product has been personalised, orders cannot be cancelled.
In the event of cancellation will be refunded by cash or voucher code which is valid for one year.
We reserve the right to cancel the order between us if
- We have insufficient stock to deliver the products you have ordered
- The price or description of the products was listed incorrectly due to a typographical error or an error in the pricing information received by us from our vendors.
If we do cancel your order we will notify you by email and refund any sum paid by you to your credit or debit card. We will not be obliged to offer any compensation for loss or disappointment suffered by you.
Pricing information; Availability
LoveWishesFlorist.com or the Florist and Vendor cannot confirm the price or availability of an item until after your order is placed. Pricing or availability errors may occur on the Sites or through the Marketplace. The receipt of an order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell a product.
LoveWishesFlorist.com or the Floirst and Vendor reserves the right to cancel any orders containing pricing or availability errors, with no further obligations to you, even after your receipt of an order confirmation or delivery notice from LoveWishesFlorist.com. LoveWishesFlorist.com or the Florist and Vendor may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation.
If products are damanged or faulty
Because of the perishable nature of many Products you are advised to make any complaint within same day of the delivery date of your Products.
If any flowers arrive damaged, die within the same day of delivery you should take a digital photograph of them and email it to hello@lovewishesflorist.com or take the flowers to the florist shop that delivered them.
If you want a refund not a repair or replacement we will refund you the price and the delivery costs and the cost of returning it to us. Please send us a receipt for the return postage costs.
We will inspect all Products returned to us as faulty or damaged. If we discover that they are not faulty or damaged we may recharge you for the Products and the costs incurred by us.
If we have sent you the wrong products
If we send you a Product that you have not ordered please use our returns policy. If you return it to us we will refund the price, the original delivery costs and the cost of returning it to us.
PAYMENTS
Your order will only be processed if full payment details are given. All orders made on LoveWishesFlorist.com are processed by the Florists and Vendors.
We accept payment by credit and debit card. Unless you hold an Account we will not dispatch a product until we have received payment from you. If for any reason payment is refused after we have dispatched the products we will have the right to request the payment from you or recover the products from you and charge you for our costs in recovering the products or seeking further payment.
Your order will be acknowledged via e-mail confirming your details if you enter a correct e-mail address, on the understanding that delivery is subject to availability. You will also be issued an order reference number for any future correspondence. Acceptance of the order will take place on the allocation of the goods to your order.
Payment may be made by any of the methods indicated on the payment page and will be debited when you place your order. If any credit or debit card offered for payment is declined by the card provider, we will make every effort to contact you on the number given at the time of ordering for an alternative form of payment. If, for whatever reason, we are unable to contact you and an alternative form of payment is not provided, the order will be cancelled.
You will be charged the current price for buying goods from our website on the date you place your order. All prices are displayed on our website and are exclusive of tax. We do our best to make sure that prices are correctly shown but very occasionally an error may occur due to systems failure. If this should happen or the tax rate changes, we will correct the price and ask you to confirm whether or not you wish us to complete your order.
We never store or have access to your credit or debit card details.
DELIVERY POLICY
Products will be delivered to an address designated by you, if applicable, so long as such address is complete and accurate. All transactions are made pursuant to a delivery contract, and, as a result, risk of loss and title for Products pass to you upon delivery of the Products to the carrier.
Some products may be available for pick up at physical Florist locations. Some products may have restricted delivery within the country. Estimated delivery times are determined based on the method of delivery chosen when products are purchased and the destination of the products.
Via our network of florists and vendors we are able to offer the delivery services detailed below. Florist and Vendor delivery services are generally available within the Malaysia, however, please note the following:
- Some delivery services are subject to availability.
- Some delivery services may be withdrawn without notice during busy periods.
- Some delivery cut off times may vary without notice during busy periods.
- At certain times of the year delivery prices may vary.
- Deliveries are not generally available on public holidays.
- If you request delivery to remote areas which are not normally delivered to by LoveWishesFlorist.com you will be advised of any additional charges as soon as possible upon receipt of your order.
There are some locations where we do not have a florist and vendor available to deliver floral gift products. In this event your floral product will still be arranged by LoveWishesFlorist.com but delivery will be via a specially selected courier.
Please note the following:
- Orders placed by 3pm will be despatched the same day from Monday to Friday.
- Order placed by 12pm for same day delivery on Saturday.
- Sunday delivery need to placed order latest by 12pm on Saturday.
- Standard delivery (9am to 6pm) at office hours from Monday to Sunday.
- 2 days advance order for delivery on public holidays and any orders received on a public holiday will be processed the next work day. Delivery is also not available for specific times. These exceptions will be made clear during the ordering process.
- Courier deliveries are not available on Sundays or public holidays. Delivery is also not available for specific times.
- Couriers cannot deliver to a University Campus, as generally there is no access beyond security/reception areas.
- We do not recommend courier deliveries to hospitals or funerals.
Neither we, nor any courier or postal service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.
Please ensure that you enter full and accurate details, including the address and the postal code, of the recipient. We will not be responsible for any orders which are not delivered due to incorrect or incomplete information being supplied by you. We will notify you in the event of any delivery problems encountered. We reserve the right to contact the recipient using the contact details you provide to us.
Please be aware that your order will be delivered to the address provided in good faith and we cannot accept responsibility if the intended recipient is no longer at that address and the receiver refuses or fails to return the item(s).
In the event of being unable to find someone to accept delivery, or where it is not possible to leave the delivery in a secure location, a card will be left at the recipient’s address with collection details, or if delivery is via a Network Florist or Vendor, the Network Florist or Vendor’s contact details, to enable the recipient to contact them and re-arrange delivery. If the recipient fails to collect or make contact in good time to re-arrange delivery we reserve the right to charge for a re-delivery to that or an alternative address.
During peak periods delivery dates may be moved forwards to ensure delivery is made before or on the intended day of delivery. We will attempt to notify you of these changes but shall not be held liable.
OFFERS AND PROMOTION CODES
At our discretion, from time to time, we may offer products at discounted prices. These offers are valid from the time that we introduce them to the end date of the offer and they cannot be used for purchases before the offer introduction date or after the offer end date.
In the event that a customer has made a purchase and the price of the purchased product subsequently falls or is discounted owing to a special offer, the price of the product at the time of purchase shall prevail. We are unable to offer special offer discounts for purchases that have already been made.
As our special offers are contingent on availability, we may change the terms of special offers and promotional codes, or withdraw them altogether, at any time, and without prior notice.
Selected promotional codes may be restricted for use against specified products or services - details of any restrictions will be communicated at the point where we promote the promotional code to you.
Discounts and credits cannot be used in conjunction with any other offers.
Unless otherwise stated, we only allow one promotion code to be used per order.
Voucher code expires 12 months from the date that it is added to an account.
We reserve the right, at our absolute discretion, to expire or revoke credit, or to temporarily remove the ability to redeem credit on our site.
Unless otherwise specified, discounts are only valid for single bouquet purchases and are not valid for bundles, gift subscriptions or regular subscriptions.
CIRCUMSTANCES BEYOND OUR CONTROL
Adverse weather conditions
During adverse weather conditions (including but not limited to heavy rain, flooding or high winds), our delivery partners may not be able to deliver orders on time. This is outside of our control and we cannot accept responsibility for the late delivery of the order. Therefore, in the event of adverse weather conditions, we aren't able to refund or offer re-delivery of affected orders.
Force Majeure
LoveWishesFlorist.com shall not be liable for delay in performing or for failure to perform its obligations if the delay or failure results from any of the following: (i) Acts of God, (ii) outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) the act of any government or authority (including refusal or revocation of any licence or consent), (iv) fire, explosion, flood, fog or adverse weather, (v) power failure, failure of telecommunications lines, failure or breakdown of plant, machinery or vehicles, (vi) default of suppliers, sub-contractors or delivery partners, (vii) theft, malicious damage, strike, lock-out or industrial action of any kind, and (viii) any cause or circumstance whatsoever beyond LoveWishesFlorist.com reasonable control.
